न्याय देणार तरी कोण?
काही कामा निमित्त हायकोर्टात गेलो होतो. कोर्टात लोक का जातात? असा प्रश्न मला लहानपणी पडायचा . पण मी तसा प्रश्न कोणाला विचारु शकलो नाहीझाले . आता कोर्टात माझ्याच कामासाठी आल्यावर आणी माझ्या प्रकरणाचा नंबर येईपर्यंत इतर दाव्याच्या संदर्भात जे कानावर पडते त्यामुळे मन अस्वस्थ झाले होते. कोणाला कामावरून काढून टाकल म्हणून , कोणी आपल्या पत्नीला घटस्फोट देवूनही पोटगी दिली नाही म्हणून कोणी पैसे भरूनही घराचा ताबा दिला नाही म्हणून तर कोणी नवरा पत्नीला , पत्नीचा दर्जा देत नाही म्हणून. दावा चालवणारे वकील आपल्या आशिलाची बाजू प्रभावीपणे मांडता यावी म्हणून स्व;तासमोर कागदपत्रांच्या फाईलना रंगीत मार्कर लावून या पानांशी पुन्हा पुन्हा रियाज केल्याप्रमाणे थांबत होते.आपला नंबर आल्यावर,फिर्यादी पक्षकारावर कस तुटुन पडायचं ह्याची ती मनात रिहर्सल होती.मला त्या दृष्याची गंमत ही वाटत होती आणी अस्वस्थपणाही. जर एखादा वकील एखादी केस हरला तर त्याची मानसिक स्थिती काय असेल ? पक्षकार त्याला ठरलेले पेंसे देइल का?पक्षकाराचे त्या वकिला विषयी काय मत होईल?केस हातून गेल्यावर वकीलाचा आत्मविश्वास डळमळीत तर होणार नाही ना? की माझ्या बापाचं काय गेल ? असा विचार त्याच्या मनात येईल.आपली तयारी कमी पडली ह्याची खंत त्याला वाटेल का?
कितीतरी प्रश्न ,माझ्या मनाला चाटून गेले. त्या प्रशांना नीच मला घाम फुटला . त्या काळ्या डागल्या खाली किती विवंचना दडली आहे हे फक्त त्यालाच माहिती . कधी कधी तासनं तास बसूनही प्रकरण पुकारले गेलेच नाही तर वेळ वाया गेल्याने येणारी अगतिकता त्याच्या आशिलाला कळत असेल का? आपली तयारी कमी पडली ह्यची खंत त्याला वाटेल का ?आपल्या अशीलासाठी खोट बोलाव लागल किंवा फसवाव लागल तर त्याच मन त्याला खात असेल का ?एखाद्या अशीलाची बाजू मांडतांना त्याचा रक्तदाब वाढत नसेल ना ?अचानक प्रकृती बिघडली तर त्यांना कोण मदत करत असेल ? फिर्यादीचा वकील आणि पक्षकाराचा वकील ह्यांचे संबंध कसे असतील ?दोन्ही वकील आपल्या अशिलाचा खिसा नित कप्ता यावा या करिता कोणती नीती वापरात असतील ? वकील अशीलाची बाजू मांडतांना सत्य बोलण्याचा आग्रह समोरच्या माणसाला करताना स्वतः तो तत्व पाळू शकेल का ? कितीतरी प्रश्न मनात पिंगा घालत होते .
ह्या प्रश्नांची उत्तरे मिळणार नाही हे माहित असूनही मन उगाचच धावत होत.माझ्या सहकाऱ्याची केस यायला अवकाश होता.माझा नंबर येई पर्यंत दुसर तिथे अन्य कामही नव्हते . त्या थंड जागेत नुसतेच बसून झोप येत होती.वकिलांचे युक्तिवाद ऐकुनच बहुदा झोप येत होती भल्या माणसान कोर्टाची पायरी चढू नये अस म्हणतात, ते का? ते तिथ मला समजल कोणाची केस सात वर्ष तर कोणाची केस तेरा वर्ष कोर्टात चलू होती . न्याय मिळण दूर कोर्टाच्या पाय-या झीझवून गाठीशी असलेले चार पैसे , हक्काचं घर वकिलाच्या फी पोटी गायब झाल होत क़धि तरी अंध देवतेला जाग येईल, गेलेलं वैभव परत मिळेल ह्या आशेवर माणूस कोर्टाची पायरी चढत होता. न्यायाला उशीर म्हणजे न्यायाला नकार हे गुळगुळीत वाक्य नाही याची कल्पना तिथ आली. पैसेवाला आपल्याला न्या मिळेल ह्याची व्यवस्था करू शकतो किंबहुना त्याच्या बाजूने न्याय लाऊन देणारे कायद्याचे पालक तयार असतात पण सामान्य माणसाचे काय ?
न्याय व्यवस्था श्रीमन्तानची बटिक आहे म्हटलं तर खोट आहे का? सामान्य लोकांना अभिव्यक्ती स्वातंत्र नाकारले जाते. त्याचा आवाज कुणापर्यंत पोचत नाही . सामान्य माणसाला न्याय न्यायव्यवस्था देवू शकेल का? हाच खरा प्रश्न आहे ?कोणाच्या भावना दुखावतील आणि त्या बद्दल कोणाला शिक्षा होईल ह्याचा नेम नाही . न्यायदानाच्या ठोकळेबाज पद्धतीन,गुन्हेगार आहे हे माहित असूनही पुराव्या अभावी शिक्षा न्यायालय देवू शकत नाही . योग्य न्याय देता आला नाही म्हणून न्यायाधीशांना दुख होत असेल का ? ज्याच्याकडे धन नाही त्याला न्याय मिळू शकत नाही. मिळालाच तर तो ऐकण्यापुर्वी त्यने जगाचा निरोप घेतलेला असतो .
गरीब माणसाच्या र्हीदायाची स्पंदन त्या न्याय देवतेला का दिसत नाही ? कि हे सारे दिसू नये म्हणून गांधारी सारखे तिने डोळे मिटून अंध असल्याची भूमिका वठवली आहे ? गरिबासाठी न्याय देणार कोण हाच खरा प्रश्न आहे ?
